Here are the high points:
The FMC and ANPRM (Advance Notice of Proposed Rulemaking) are reviewing alleged ocean carrier's recent alleged tariff fees.
There has been notice that the charges vary greatly and the minimum range requirements for accessing common carrier tariffs are extremely broad
The issue affects not only shippers who regularly ship under tariff rates, but also for shippers utilizing BCO contracts.
As a result, shippers may need to have complete access to tariffs to ascertain the applicable rate for their cargo once the MCQ has been fulfilled.
This issue has also been recognized in the NVOCC sector as "pass-through" charges where the practice of some carriers to incorrectly pass-through charges limit shippers visibility to total freight cost as well as any prior notice.
The FMC is requesting answers to six critical questions from VOCC and NVOCC alike in which comments are due 60 days after the publication of the investigation in the federal register.
